Each week, I receive questions regarding the legality of cannabis testing in certain areas of the nation. Employers must unravel a complex network of laws as legalization efforts gain momentum. This will ensure that they are in compliance and maintain workplace safety. How?
Consult with your lawyer. The laws regarding recreational or medical marijuana are not the same in every state. There may be laws that are applicable to local jurisdictions, including counties or individual cities. Laws governing marijuana use aren’t the only concern, either. Some states have introduced standards impacting the hiring process. The Department of Labor in New York has stated that employers can’t discriminate on the basis of marijuana use. All public and private state employers, no matter their size or industry, are subject to this law. Similarly, Philadelphia enacted a new law on January 1, 2022, that prohibits employers or agencies acting on an employer’s behalf from requiring a pre-employment drug test for marijuana. Bottom line: Before you change existing policies, or create new ones for employers, make sure they are reviewed by your lawyer to verify that they conform with applicable regulations.
Consider aligning your marijuana use policies with your existing alcohol use policies. The 1991 New York City subway accident was a major catalyst for current Department of Transportation requirements about workplace substance abuse.
