Additional Faqs From The Community:

“Who can we contact about our background check status?”

Start with the company you’ve applied to for an update about your background check’s status. If that doesn’t work due to nonresponse or lack of information, you can also try to reach out to the company running the background check if you have that information.

“I received my offer letter subject to background verification. But, I have not heard back if it has been cleared. Should I contact HR?”

Unless you expect something to show up on the background check that would disqualify you for the position, it is safe to assume your onboarding process is on track. You would most likely hear if there was a problem, but it would be appropriate for you to reach out to your future employer to verify.

“I missed city court on a misdemeanor charge due to covid. The warrant was issued. Will this show up on a state police background check?”

“I interviewed on Monday, and they told me that the company would conduct a background check the next day. It’s Friday, and nothing has come to my attention. What can I do?

Give it a little more time. The company may have waited a couple more days to start your background check, or the background check company could be delayed. For an update, contact the interviewer next week.

“I have been waiting for my background to clear for a position in the government since May 2020. I was informed by the agency that there is a backlog, but non-governmental employers get them back faster. This is what could it possibly signify?

“My background check came back and reported that I am ineligible to work at a day care. Why?”

You can ask the employer for a copy of the full report. If the company is not wiling to provide it, you have claims to pursue against the employer under the FCRA.

Amazon Background Checks: What are they and how do they work?

All potential employees must undergo an Amazon background check. The background check covers seven years of arrests and criminal convictions.

Amazon employs a professional to perform these checks. They search all public records looking for the information. The company can then consider convictions in its hiring decisions.

Fingerprints are not required as part of the Amazon background check process. All information over the past seven years, however, will be considered. This includes any arrests, felonies, misdemeanors, or charges that have been made since you’ve owned the property.

This process is in place so that Amazon can ensure they are hiring the best possible candidates for their open positions. By conducting thorough background checks, they can avoid making any poor hiring decisions that could negatively impact their business.

False Credentials

Trusting your employees is key. You have to trust them to do their jobs, to treat customers and partners with respect, and to represent your brand appropriately.

Verifying credentials is particularly important when you consider a recent report from CareerBuilder. According to the report, 58% of resumes contain misleading or inaccurate information. This includes false education details, incorrect job titles and seniority levels as well as employment dates.

While some inaccuracies involve things like minor date discrepancies, and therefore probably won’t have a negative effect on work performance or company image, others are more serious. You might remember the case of former Yahoo CEO Scott Thompson, who landed in the headlines for allegedly misrepresenting his college degrees.

Hiring someone with false credentials can directly affect your existing employees, too. If employees don’t really have the experience or education they say they do, they may not be fit to do their job. And that can interfere with the whole team’s performance, as everyone relies on each other to pull their weight.

The survey also showed that managing a poor hiring choice in this respect can take 17% of a supervisor’s time (that’s almost a whole day per week!). A bad hire can mean less business growth.

Therefore, running a background check is a surefire method to ensure you are hiring a candidate based on facts, giving you peace of mind and ensuring no time or effort go wasted. Using a background check service like GoodHire to verify education, employer history, and professional licenses earned helps you confirm candidate qualifications and move forward with certainty.

Amazon requires drug tests

Amazon demands drug testing for all new employees. You must agree to a mouth swab, which typically happens after the in-person interview.

Each swab is lab-tested in search of common recreational drugs that are illegal in your state.

While some applicants may use a home drug testing kit to ensure they are in the clear, Amazon requires annual medical assessments that include a drug test.

Amazon reserves the right of drug testing staff. Regular recreational drug use will also be considered a crime.

Workplace Safety Remains Paramount As Marijuana Laws Evolve

Each week, I receive questions regarding the legality of cannabis testing in certain areas of the nation. Employers must unravel a complex network of laws as legalization efforts gain momentum. This will ensure that they are in compliance and maintain workplace safety. How?

Consult with your lawyer. The laws regarding recreational or medical marijuana are not the same in every state. There may be laws that are applicable to local jurisdictions, including counties or individual cities. Laws governing marijuana use aren’t the only concern, either. Some states have introduced standards impacting the hiring process. The Department of Labor in New York has stated that employers can’t discriminate on the basis of marijuana use. All public and private state employers, no matter their size or industry, are subject to this law. Similarly, Philadelphia enacted a new law on January 1, 2022, that prohibits employers or agencies acting on an employer’s behalf from requiring a pre-employment drug test for marijuana. Bottom line: Before you change existing policies, or create new ones for employers, make sure they are reviewed by your lawyer to verify that they conform with applicable regulations.

Consider aligning your marijuana use policies with your existing alcohol use policies. The 1991 New York City subway accident was a major catalyst for current Department of Transportation requirements about workplace substance abuse. After the engineer was found to be under the influence of alcohol during the crash investigation, Congress passed the Omnibus Transportation Employee Drug Testing Act of 1991 (a crack vial was also found in the engineer’s cab). Now that marijuana, like alcohol, is legal in many states, it makes sense to handle compliance similarly. A risk-appropriate drug screening policy that addresses the employer’s pre-hire and post-hire requirements represents a contract between employers and their employees to ensure workplace safety and the public that these employees may interact with. It can be used consistently and fairly to ensure new and existing employees have safe work environments. Even if marijuana is decriminalized in the state where they reside, a good policy allows people to continue their normal work routines.

Important to remember that decriminalized marijuana usage is not prohibited in all locations. For example, certain job categories are exempt, including positions in law enforcement, positions requiring a commercial driver’s license, and positions of trust, such as those involving the supervision or care of children, medical patients, or other vulnerable persons. You can reduce risk wherever it’s most necessary, while also adjusting background screening policies and drug testing policies in order to comply with new standards.

Step 2: Ensure Legal Compliance Of Your Policy

Compliance failure could result in heavy penalties and fines of up to millions of dollars.

So, before implementing a background check policy, consult with a legal expert to ensure that it does not violate any legal requirements.

These are the most important things to keep in mind.

1- Companies running background checks in-house do not require an applicantas consent. However, the FCRA still requires companies to follow a three-step adverse action process when making unfavorable decisions due to an investigation.

  • You can send a Pre-Adverse Action Notice with a copy of any public information that was used during the background check. Also, include a Summary of Rights.
  • Give candidates suitable time to respond.
  • Send an adverse action notice listing the reasons and background.

2- Another legal aspect to remember is the ban the box laws. If an organization is in a state where these laws apply, it must ensure that the background check only starts after the conditional job offer to the applicant.

3. The U.S. Equal Employment Opportunity Commission (EEOC) enforces Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination based on sex, race, color, religion, or national origin. Some background checks, such as criminal records, can lead to discrimination against minority citizens whoare often arrested for minor offenses. Therefore, a companyas policy should consider this factor when evaluating screening results.

Amazon Background Check Policy 2022

Step 1: Develop A Comprehensive In-House Background Checking Policy

An in-house background checking policy governs your pre-employment screening activities, defines their scope, assigns responsibilities, outlines policy actions, and ensures compliance with the relevant federal and state laws.

It is critical to develop a background checking policy to avoid inconsistencies in your background screening activities that could potentially result in legal and administrative problems.

Different organizations develop screening policies based on their business needs. However, every in-house background checking policy needs to cover the following points.

What happens if you fail the background check?

You won’t qualify to be an Amazon Flex driver if you fail your background check.

This exception is only if the background information you have provided is not correct.

Common interpretations of the Fair Credit Reporting Act (FCRA) hold that background checks for independent contractors should observe the same requirements as those for potential employees.

This means that you have the right to be informed if the information found in a background check has been used to disqualify you from driving for Amazon Flex.

To comply with the Fair Credit Reporting Act and some state laws, companies must send you a notice informing you of a negative outcome regarding your background check. You must be provided with instructions on what to do if the results are not correct.

You must ensure that the accuracy of your report is checked. Background check companies must take all precautions to make sure their data are accurate. However, mistakes do happen.

You may find that you have what is known as a “mixed file”. This is where information about other people is reported in your file. If you have the same name or reside at the same place, mixed files may occur.

The screening agency must correct any errors found in your report. Getting the data corrected is essential for your current application, and for any employment applications, you make in the future.

These errors can have serious consequences that could impact your employment prospects. If you don’t correct the mistakes, you will have problems renting an apartment or getting approval for loans, credit cards, and other consumer deals.

Although these reports are called background checks for pre-employment purposes, they are in fact credit reports.

If the background screening company fails to correct the errors in their report, you can take legal action against them.

Sometimes, accurate information can be removed from your record. It is possible to have your records expunged if you are convicted of minor offences. You will need to apply to the court for this and you should get advice from a lawyer that specializes in expungements.

With a successful expungement, you can treat the offense as if it never happened. It will not be necessary to mention the crime on applications and background checks cannot report it.

Is A High School Diploma Or Ged Required?

Yes, usually Amazon requires applicants to hold at least a high school or equivalent diploma.

We hear a lot of reports these days that Amazon hires people without secondary education because of its vastly expanding services.

Amazon requires that applicants have at least a high-school diploma or an equivalent to be eligible to apply to a job. However, the company also has new programs which throw out these requirements.

A GED is a great investment, and your company can help you get one.

Amazon has set up pilot programs to help seasonal workers get a GED diploma for free. For example, in Fort Worth, Texas the company employs warehouse associates without any high school diploma or degree.

These jobs are $15 per hour. Amazon will assist workers in earning a GED. They will also pay the costs of the four subtests ($145).

Conducting Background Investigation In-House (Step-By-Step)

Employment Screening Policies Adapt To Meet Changing Marijuana Laws

California voters passed the first state law legalizing medical marijuana in 1996. The number of legalizing medical or recreational marijuana in states has increased since 1996. There are 38 states that now allow medical marijuana, including the District of Columbia and Puerto Rico. 18 other states also permit recreational use. Although marijuana is still illegal under federal law, employers are reviewing background screening requirements to adapt their policies for the new legal environment.

Background Checks For Employment

It’s important to be familiar with background checks before you apply for employment.

Background screening or the process of performing a background check, consists of researching and consolidating a variety of employment, educational, criminal, financial, and other records about an individual or organization for the purpose of evaluating that individual for employment purposes.

1- Non-Compliance With Federal And State Laws

Non-compliance of relevant laws and regulations is one of the greatest risks when conducting background checks within the company. Since in-house employees are often not used to conducting background checks, they can easily overlook the necessary legal requirements and get your company in trouble.

The failure to timely detect red flags in an applicantas background or incorrectly declining employment due to a false flag are both huge risks that can get organizations heavily penalized under the FCRA, EEO, and other relevant laws.

Amazon is the U.S.’s second-largest employer, and the e-commerce firm offers job opportunities at every stage.

  • Amazon Background Check Policy: Are you interested in working with Amazon? Here is what I know about this!
  • Amazon Background Check Policy 2022 (All You Need To Know)

    Amazon’s 2022 Background Check Policy:

Amazon can conduct background checks. They will check criminal convictions for past seven years. These background checks take place after the in-person interview and before hiring is confirmed to ensure new employees are trustworthy. Amazon will hire individuals with criminal records, but each case is treated individually.

You can read on if you are interested in Amazon’s background-check policy for employees and potential candidates.

What Is The Amazon Application And Interview Process?

Amazon is a major employer for one million Americans and takes their hiring policies very seriously.

Before Amazon runs background checks, the hiring process starts with an online application, followed by an interview. Apply online at www.amazon.jobs/. Questions vary by job.

This is a similar process to any other online job submission, as you can explore different positions and provide any required information about yourself after you make an account and start an application.

Amazon will get back to you once the application is submitted. Amazon will get back to you with the next steps.

Amazon senior roles require that you complete an assessment. This will take approximately 20 to 30 minutes. Amazon can use this as a means to verify your competences and skills for the specific role.

After a successful assessment or if you are applying for a manual role such as a warehouse fulfillment worker or delivery driver, your application will proceed to the interview stage. Amazon sometimes conducts phone interviews, while other companies prefer in-person interviews.

Amazon will offer you a job conditionally if you answer all the questions correctly and are a suitable candidate for the position. You must also pass the background check for all employees.

Amazon Background Check Policy 2022 (All You Need To Know)

Amazon Background checks: What is it?

Amazon will require a complete criminal background check. Fingerprints are not necessary for hiring. It must go back to seven years in order for the company to consider convictions during this period, including felonies.

Additionally, Amazon may hire people with convictions, but they treat each prospective employee on a case-by-case basis.

While it depends on each situation, generally, Amazon is less likely to hire someone with a record for fraud or stealing from a former workplace.

Instead, applicants with low-level drug offenses or other crimes that shouldn’t directly impact the job role and responsibilities are more likely to be considered.

Amazon is currently using a professional service to conduct conventional background checks. This search will reveal all arrests and felonies as well as misdemeanors or charges.

Amazon can make a hiring decision for you within days of the completion of your background check.

Amazon provides notification to candidates disqualified by background checks under the Fair Credit Reporting Act guidelines.

The FCRA states no employer is legally allowed to consider any criminal conviction from over seven years ago. So if you have a conviction that’s older than seven years, Amazon cannot use it when deciding whether to hire you.

However, some states have additional regulations that minimize this time even more. For more information on how far back Amazon is allowed to examine your criminal background, please consult the state law.

    Does Amazon Do Reference Checks?

Amazon has another part of its hiring process that includes references checks, but they tend to be very brief given the number of applicants.

Simply put, hiring managers want to find out what your references are checking out. They usually don’t pay too much attention to detail such as position title, pay, overall performance, etc.

Naturally, companies need to be able to identify the people they’re hiring. Reference checks give Amazon the chance to verify the information on your resume.

In most cases, Amazon will look at just your last boss or check in with a few, depending on your employment history and the job you applied for.

Although they may seem daunting at first, you shouldn’t worry too much about reference checks, especially if you left a good lasting impression in your most recent workplace.

You are more likely to pass reference checks if you have a clean and truthful resume.

Amazon doesn’t require you to have a resume for hourly work. In that instance, Amazon is more concerned with the application, background check, drug test, and then interview.

Amazon Background Check Policy 2022 (All You Need To Know)

Amazon demands drug testing for all new employees. After the interview, you will be asked to give a sample of your mouth.

Each sample is tested in a lab for common recreational drugs found in your state.

Amazon will require an annual medical assessment that includes a drug test.

Amazon reserves the right of drug testing staff. Regular recreational drug use will also be considered a crime.

For more information about Amazon’s policies you might also want to check out our post on Amazon VTO and Amazon transfer policies.

Amazon currently does not require fingerprinting as part of its background checks. Amazon uses a public record-checking platform that includes extensive information.
